California Chapter 7 Bankruptcy
Through Chapter 7, you can wipe out your unsecured debts entirely. In exchange for discharging your debt, which eliminates your legal responsibility to pay it, California laws allow a court-appointed trustee to sell some of your possessions to repay creditors. However, in our experience, this rarely occurs. DebtStoppers can help you wipe out your debts, keep your belongings, and move on with your life!
What Are the Filing Requirements?
District court rules place limitations on who is legally permitted to file for bankruptcy. To qualify, you will be required to participate in credit counseling with a trained financial counselor and attend a financial education course. The courses are completed online, and your DebtStoppers attorney can handle all of the arrangements.
The Means Test and Income Limits
Only people who pass the “means test” are eligible to file Chapter 7. The test assesses your household and disposable income to determine if you have the means to pay what you owe without bankruptcy’s help. If your income is above the limits, you don’t qualify to file Chapter 7.
The California Chapter 7 Process
The first step in the process is to file the required forms at the closest bankruptcy court. As soon as you submit your petition, the court will issue an automatic stay that prohibits your creditors from trying to collect from you or even contacting you.
Once your petition is filed, a court-appointed trustee will set up a 341 meeting where your creditors can protest your debt being discharged. While creditors rarely attend these meetings, your DebtStoppers lawyer will help you prepare and be by your side during the meeting.
After the 341 meeting, the trustee will evaluate your assets. While California laws technically permit the trustee to liquidate your assets to pay some of your debts, most of our clients don’t lose a thing.
How Much Does it Cost To File Chapter 7?
Our attorney fees can vary depending on your family’s circumstances, but our rates are some of the most competitive in the Los Angeles area. In addition to your legal fees, the court will assess a $335 filing fee when you submit your petition. At DebtStoppers, we know that coming up with the funds to pay this fee can be challenging for struggling families. Instead of waiting for you to find the cash, we’ll advance the filing fee to the court and let you pay us back after your debts are eliminated.
